Texas School Safety Center (https://txssc.txstate.edu/), located in San Marcos, Texas, is currently addressing issues of COVID-19 in the public schools. However, a couple of years ago, they were tasked with the mandate to develop a response to the issues of Bullying and Cyberbullying. Based in the cases we have been reviewing in this week’s topic, the Texas School Safety Center developed a School Safety Law Toolkit. In 2011, the Texas Education Code was was amended to include §37.0832, which defined bullying for school districts and described the types of anti-bullying policies each school district was to include in their anti-bullying policies. In 2017, the legislature again amended the Texas Education Code to include “David’s Law,” though SB 179, and developed a legal checklist for use by campus administrators to ensure that, if followed, there would be no question regarding the discipline of off-campus behavior that “materially and substantially” disrupted the educational environment. (Tinker v Des Moines).
Substantial Disruption (Tinker v Des Moines)
Obscene Speech (Bethel v Frazer)
Speech that encourages illegal drug use (Morse v Frederick)
Resources to Review
Use this link to watch a short video of the TEXAS BULLYING LAWS (https://txssc.txstate.edu/videos/bullying-and-the-law/).
Scroll down below the video frame for additional information in the Bullying Toolkit, including a Bullying Checklist that will allow an administrator to identify bullying and be able to take appropriate action under the current legislation.
Questions to Discuss
Explain the Substantial Disruption clause and the impact that it has on off campus behavior.
After watching the Texas Bullying Laws video and reviewing the Bullying Checklist, respond to these questions:
How is this tool used on your campus? Is a similar tool used for your campus?
What improvements can be made using the tools from the TSSC?
If the tools are not being used on your campus, how can you impact changes by introducing these tools to your peers?
